Ladies and Gentlemen:

Section 15422(a) of the Food, Conservation, and Energy Act of 2008, also known as the Farm Bill, requires notification if the FIRST SALE
pricing method is used at the time of filing.
This new requirement becomes effective September 19, 2008.
In fulfilling the FIRST SALE DECLARATION REQUIREMENT, the transaction value of the imported merchandise is based upon the price paid by the buyer
in the first or earlier sale occuring prior to introduction of the merchandise into the U.S. This requirement applies to all goods admitted for consumption
or withdrawn from a bonded warehouse.
This information will be electronically transmitted with the entry summary. In the event of a FIRST SALE TRANSACTION an "F" will be shown next to the
declared value. If this is not the case, then nothing will appear.
If your goods fall under the FIRST SALE DECLARATION REQUIREMENT, you must declare it on your invoice. If no declaration is stated we will assume that it
is NOT a first sale and will file your entry accordingly.
If ALL of your transactions fall under one of these criteria please issue us a letter advising so and we will keep it on file and use it with all of
your shipments.
